This sales contract is made between Cynthia P. Wallen of Beau James Pomeranains-party of the first part-termed the seller and the party of the second part-termed the buyer whose name address and telephone number appear at the bottom of this contract and does hereby obligate the buyer and seller to the terms of this contract when signed by both parties.
The seller agrees to sell, and does hereby sell, and has contracted to the buyer a dog of Pomeranian breed: In sound body and good health, and free from communicable disease as far as appears to the eye. A 72 hr. warranty against distemeper, hepatitis, leptospirosis, adenovirus 2, parvovirus, and coronavirus applies to this dog. All pet puppies must be spayed or neutered-without exception. For pet puppies registration papers will not be given until vet proof of spay/neuter is received by the seller. Online registration is available once the vet proof is received. Dog MUST BE MAINTAINED on Nu-Vet Plus supplement for the entire life of the dog to ensure proper nutrition. To order-call 1-800-474-7044. Use order code 4769-6. It is strongly suggested as well that Oxyfresh Oral Hygiene Solution and Pet Gel be used to maintain proper dental hygiene for the life of the dog. Call 1-800-223-7374 order code #180595953. Dental health cannot be maintained without proper maintenance by the buyer. If death occurs due to warranted defect-then dog must be shipped to State of Ohio lab for necropsy and full necropsy report must be given to seller to validate this warranty. Seller does not guarantee eventual size, color or quality of dog. No other warranty either express or implied exists between the buyer and seller of this dog. A health check by buyer's veterinarian (or buyer be present at seller's vet check) must be done within 72 hours after receiving the dog. Veterinary expenses are the sole responsibility of the buyer. Buyer is also responsible for the costs associated with the vet check, shipping crate, (where applicable) and shipping costs (where applicable). Shipping within USA is $350.00. This contract is agreed upon by both parties and is not subject to change for any reason. Deposits and purchase amounts are non-refundable. Warranty is confined to replacement of animal. Buyer agrees not to place this animal in a shelter for any reason. In the event the buyer is unable to keep the animal it will be returned to seller at buyer's expense. Full ownership transfers back to seller-and AKC papers will be transferred back to seller. The seller will then attempt to sell the dog and convey the amount of the original sale to buyer-minus vet expenses and boarding expense of $5.00 per day. Transportation costs for return of dog to seller are the sole responsibility of the buyer. Both parties agree that the point of sale origin is Richland County, Ohio-USA.
